General Provisions
This Agreement constitutes a public offer in accordance with Articles 633 and 641 and Chapter 63 of the Civil Code of Ukraine and sets forth all essential terms governing the sale of goods both remotely through the online store https://tory.ua
and offline at the flower, gift, and decor studio “TORY ART” located at 59 Zhilyanska Street, Kyiv (hereinafter referred to as the “Seller”).
The terms of this Agreement apply equally to all visitors of the online store and the “TORY ART” studio, regardless of their legal status.
Full acceptance of this Agreement is confirmed by placing an Order. If the Buyer does not agree with these terms, the offer shall not be accepted.

2. Definitions
Key Terms
Product — items available for purchase in the online store.
Catalog — product information displayed on the website.
Order — the Buyer’s purchase request placed through the shopping cart.

Buyer — any legally capable individual or entity purchasing goods.
Acceptance of Offer — payment for the ordered goods.
Claim (Reclamation) — a complaint regarding product quality or quantity.
All parties agree to interpret these terms strictly as defined herein.
3. Subject of the Agreement
The Seller undertakes to transfer ownership of the Product to the Buyer, and the Buyer undertakes to pay for and accept the Product under the terms of this Agreement.
4. Conclusion of the Agreement
The Agreement is considered concluded upon acceptance of the offer.
Payment for the Product serves as full confirmation of acceptance.

Seller’s Rights
- To modify terms, pricing, and product assortment unilaterally
Seller’s Obligations
- To fulfill Orders properly
- To provide Products of proper quality
- To notify Buyers of force majeure circumstances
- To ensure confidentiality of Buyer data
6. Order Placement
Orders are placed independently by the Buyer through the online store.
7. Pricing and Payment
Product prices are publicly displayed on the website.
Total Order cost includes Product price and delivery charges.
Payment may be made using available methods indicated on the website.
8. Delivery
Delivery is available by courier within Kyiv or by pickup at the “TORY ART” studio.
Receipt of Products confirms acceptance without claims.
Delivery timelines may be adjusted during holidays.
9. Returns and Refunds
Defective Products may be replaced within two business days following submission of a written claim.
Flowers and plants are non-returnable once received or used.
Refunds for canceled unfulfilled Orders are processed on the next banking day.
10. Term of the Agreement
This Agreement becomes effective upon acceptance and remains valid until all obligations are fulfilled.
11. Disclaimer of Warranties
All Products and website materials are provided “as is.”
Actual colors and sizes may vary slightly.
The Seller is not liable for damages arising from website use.
12. Miscellaneous Provisions
The Buyer consents to personal data processing and marketing communications.
The Seller reserves the right to modify the Agreement and website at any time.
All disputes shall be resolved through negotiation or in accordance with Ukrainian law.
